ACK/NAK licence terms.

These terms apply to the ACK/NAK apps for Windows, macOS and Android and to the ACK/NAK Relay service (together, “ACK/NAK”). ACK/NAK is published by GoPlaces Consulting LLC (“GoPlaces”) and distributed by WestLat Design. By activating or using ACK/NAK you agree to these terms.

1. Licence

GoPlaces grants you a non-exclusive, non-transferable licence to install and use ACK/NAK to configure GNSS receivers you own or are authorised to manage, for the term and on the number of devices your activation allows. The licence is to use ACK/NAK, not to own it. You may not copy it except for backup, modify it, reverse engineer it except where the law allows, or make it available to others.

2. Activation

ACK/NAK needs an activation code. A code is issued to a receiver and may be moved to another receiver by arrangement with your distributor. Activation and job-code use send the data described in the privacy policy.

3. The relay

ACK/NAK Relay forwards RTK correction data between receivers you or your organisation operate. Availability is not guaranteed; the relay is not a substitute for your own base station or a commercial correction network. Job codes identify a job, not a person; keep them to the crews that need them.

4. Your responsibility

ACK/NAK writes settings to your receiver. You are responsible for checking that a configuration is right for the job before relying on it, for keeping your receiver firmware current, and for complying with radio licensing and other laws where you work. Survey results depend on many things ACK/NAK does not control.

5. No warranty

ACK/NAK is provided as is. To the extent the law allows, GoPlaces disclaims all warranties, express or implied, including fitness for a particular purpose. GoPlaces does not warrant that ACK/NAK is error-free or that the relay will be uninterrupted.

6. Limitation of liability

To the extent the law allows, GoPlaces is not liable for indirect, incidental or consequential loss, including lost work, lost data, rework or re-survey costs, arising from the use of ACK/NAK. GoPlaces’ total liability for any claim is limited to the amount paid for the licence in the twelve months before the claim.

7. Term

The licence lasts for the period your activation allows. GoPlaces may end it if you break these terms. When it ends, stop using ACK/NAK and remove it from your devices.

8. Updates

GoPlaces may release updates and may change or retire features and the relay with reasonable notice. Updates are covered by these terms unless they come with new ones.

9. Governing law

These terms are governed by the laws of the State of Colorado, USA, and disputes are heard in its courts.

ACK/NAK, the ACK/NAK mark and ACK/NAK Relay are trademarks of GoPlaces Consulting LLC.
